Terms of Service

The short version
This summary is for convenience only — the numbered sections below are the binding terms.
- You need to be 16 or older to use Voidcom.
- You keep ownership of everything you post. We only get the limited rights we need to run the service — never to train AI, advertise, or sell your data.
- Voidcom is in free beta and provided "as is" — features can change and we can't promise uptime or that data is never lost.
- Don't use Voidcom for anything illegal or abusive. We can suspend accounts that break these rules.
- These terms are governed by German law, and nothing here removes the consumer rights the law gives you.
1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the Voidcom applications, websites, APIs, and related services (together, the "Service"), operated by Maximilian Tschauder, Hauptstraße 25, 88630 Pfullendorf, Germany ("Voidcom", "we", "us"). Full operator details are in our Imprint. By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility & age requirement
You must be at least 16 years old to use Voidcom. By creating an account you confirm that you are 16 or older and that you have the legal capacity to enter into these Terms. 16 is the age of digital consent under Article 8 GDPR in Germany; we do not knowingly allow accounts for people below this age. If we learn that an account belongs to someone under 16, we may suspend or delete it.
You may not use the Service if you are barred from doing so under applicable export-control or sanctions law (for example, EU restrictive measures).
3. Your account
You are responsible for keeping your account credentials and recovery material secure, and for activity that happens under your account. Voidcom uses end-to-end encryption with a password-derived key and a recovery phrase: if you lose both your password and your recovery phrase, we cannot recover your encrypted data for you. Provide accurate information when registering, and notify us promptly of any unauthorised use of your account.
4. Acceptable use
You agree not to use the Service, and not to help anyone else use the Service, to:
- break any applicable law, or facilitate illegal acts;
- harass, threaten, defame, or incite violence or self-harm against others, or distribute hate speech targeting protected groups;
- create, share, or solicit child sexual abuse material, or sexualise or endanger minors in any way;
- send spam, phishing, malware, or otherwise distribute malicious content;
- impersonate another person, entity, or Voidcom itself;
- infringe intellectual-property or privacy rights, or share others' private information without consent;
- commit fraud, run scams, or make deceptive financial or investment claims;
- gain unauthorised access to accounts, systems, or data; reverse-engineer, decompile, or scrape the Service except through our public API within its limits; or conduct denial-of-service or other attacks;
- abuse the Service as bulk storage, for cryptocurrency mining, or to circumvent these Terms with bots or automation;
- file false abuse reports or coordinate report or appeal abuse.
Serious violations — especially threats to safety, child safety, or platform security — may result in immediate suspension or termination. For less serious breaches we will, where reasonable, give you notice and an opportunity to put things right.
5. Your content
You keep all ownership of the messages, files, and other content you create or upload ("Your Content"). You grant Voidcom a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit, reproduce, and display Your Content solely to operate and deliver the Service to you and the people you send it to. This licence ends when Your Content is deleted from the Service, except for copies in routine backups for a limited period.
This licence does not permit us to use Your Content to train machine-learning or AI models, to advertise, to build profiles of you, or to share it with third parties outside what is needed to run the Service. Where Your Content is end-to-end encrypted (direct messages and voice), it is opaque to us — we transmit it but cannot read it.
You are responsible for Your Content and confirm you have the rights to share it and that it does not break the law or these Terms.
6. Beta service & availability
Voidcom is currently offered free of charge as a beta and is provided "as is" and "as available". We may add, change, suspend, or discontinue features at any time, and we do not guarantee uptime, error-free operation, or that data will never be lost. You should keep your own copies of anything important. Nothing in this section limits the statutory rights you have as a consumer under German and EU law.
7. Voidcom's intellectual property
The Service, including its software, design, the "Voidcom" name, logo, and branding, is owned by Voidcom and protected by intellectual-property law. These Terms do not grant you any right to use our trademarks or to copy, modify, or create derivative works of the Service, except as expressly permitted (for example, using our public API within its documented terms).
8. Third-party services
The Service may link to or integrate with third-party services, bots, or content that we do not control. We are not responsible for them, and your use of them is at your own risk and subject to their terms.
9. Disclaimer of warranties
To the extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. This does not exclude or limit any warranty or right that cannot be excluded or limited under applicable mandatory consumer-protection law.
10. Limitation of liability
Voidcom is liable without limitation for damages caused intentionally or by gross negligence, for damages arising from injury to life, body, or health, and where liability is mandatory by law (including under the German Product Liability Act).
For slight negligence, Voidcom is liable only where a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible at all and on which you may reasonably rely) has been breached, and in that case liability is limited to the foreseeable, contract-typical damage. Any further liability is excluded.
We do not use mandatory arbitration or class-action waivers; you retain access to the courts.
11. Indemnification
To the extent permitted by law, you will indemnify Voidcom against third-party claims, damages, and reasonable costs arising from Your Content or your breach of these Terms or of the law. This does not apply to the extent the claim results from Voidcom's own intentional or grossly negligent conduct.
12. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or the law, if required to protect the Service or other users, or if we are legally obliged to. Where proportionate and lawful, we will tell you the reason and give you a chance to respond or appeal; immediate action is reserved for serious cases such as imminent security or safety risks. On termination, your right to use the Service ends and your content may be deleted after a reasonable recovery period, unless we are required to retain it.
13. Governing law & jurisdiction
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts that the law makes available to you.
14. EU dispute resolution & point of contact
Our point of contact for these Terms and for matters under the EU Digital Services Act is team@voidcom.app, in German or English. The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not generally willing to take part in dispute-resolution proceedings before a consumer arbitration board.
15. Changes to these terms
We may update these Terms. For material changes we will give at least 30 days' notice by email, in-app notice, or a notice on this site before they take effect. If you continue to use the Service after the changes take effect, you accept the updated Terms; if you do not agree, you may stop using the Service and delete your account before then.
16. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy and Imprint, are the entire agreement between you and Voidcom regarding the Service. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor that takes over the Service. Neither party is liable for failures caused by events beyond its reasonable control, except that this does not affect our data-protection obligations.
